When do we collect your personal data?
We collect your personal data from the moment you enter or provide your information on our Website or WhatsApp, apply for a job, register on our website, use AFAS Online/Pocketapp or KEEN Planning, sign up for a newsletter, or otherwise register or are registered to use our services. We may also collect your personal data if you have posted it on public platforms that indicate you might be interested in our services. In that case, we will contact you in accordance with our terms and conditions and in compliance with this privacy statement. If you are not interested, we will delete your personal data.
What personal data do we collect from you?
We process the personal data necessary for our services; some of this data is mandatory in order to use our services. Additional data may be desirable in order to better tailor our services to the wishes and qualities of our employees or to meet more specific requests or obligations from our clients.
Filling out the contact form on the website:

Access to your personal data is limited to those persons authorized to do so. If and insofar as data is provided to third parties/processors, we have agreed with them that they, too, will provide optimal protection of personal data.
If you join Spirit or work for Spirit, we will collect additional information about:
- Bank account number;
- Information regarding the provision of travel expense reimbursement;
- Language proficiency;
- Photo, if you wish to share it, on a voluntary basis;
- Clothing sizes, if you'd like to share them—on a voluntary basis;
- Contact information for the people we should notify in case of an emergency;
- Recruitment channel;
- Physical characteristics, if applicable.
If you work at Spirit, we collect additional information about:
- availability and leave;
- Reimbursement Claims.
This information is available in AFAS Online/Pocketapp. Access to your personal data is limited to authorized individuals. If and to the extent that data is provided to third parties or data processors, we have agreed with them that they, too, will provide optimal protection for the personal data.
Why do we collect your personal data?
- We collect and process your data to conduct our business activities including entering into assignment agreements, recruitment & selection, personal development and employability, payroll and personnel management. More specifically, personal data is processed to:
- To be able to provide information about our Services;
- To send you commercial offers, newsletters, and promotional campaigns, but only if you have subscribed to them via the opt-in system. Every communication sent through this channel will include an option to unsubscribe;
- Manage and improve business relationships with clients;
- To assess an applicant's suitability and availability in connection with recruitment, selection, and hiring;
- Establishing and maintaining an employment relationship and handling the relevant personnel and payroll administration for this purpose;
- To fulfill our reintegration obligations;
- To conduct pre-employment screening on behalf of our clients and facilitate the deployment of personnel;
- To promote personal development and employability, including training, education, and testing;
- To achieve management objectives, including providing management information, ensuring internal controls and operational safety, and conducting audits and financial audits;
- To achieve quality objectives such as employee satisfaction and certification;
- Apply for subsidies, premium discounts, and the like;
- Comply with laws and regulations, including but not limited to identification requirements, labor laws,
tax and social security laws, anti-fraud measures, and national and international
sanctions laws.
With whom do we share your personal data?
Spirit Hospitality Services may share your personal data with other entities within the Sendersens Hospitality Group, its clients, suppliers, government agencies, and other business partners. We may also share your personal data in any other cases where we are required to do so, such as by court order or court judgment. We enter into a data processing agreement with these parties to ensure they handle your data with care, and they receive only the data necessary to provide their services. These parties use your data solely in accordance with our instructions and not for their own purposes. Examples include our website and app developer, our suppliers of various software systems, our occupational health and safety service, and our trainers. The disclosure of personal data is based on a legitimate interest, a legal obligation, and/or the performance of the agreement in accordance with the purposes listed under “Why do we collect your personal data?”
We will only process your data within the European Economic Area (EEA). Outside the EEA, we will only process your data if that country provides an adequate
level of protection for your data. We will never transfer your data to other countries or to parties other than those mentioned above without your consent. Spirit Hospitality Services has taken the necessary measures to ensure that the transferred personal data is adequately protected.
How long do you keep personal data?
Spirit Hospitality Services is committed to complying with the storage limitation principle. In this context, we will not store your personal data longer than necessary for the purposes we previously described. The retention periods we use depend on the applicable legal retention periods and/or guidelines.
Job Applications
Data will be retained for up to 4 weeks after the completion of the application process and will then be automatically deleted. If Spirit Hospitality Services wishes to keep your data on file for up to 1 year for potential future job openings, we will ask for your explicit written consent.
Employees
Your personal data will be retained for up to two years after the end of your employment. This data will then be automatically deleted. Certain types of personal data are subject to a tax retention requirement, which means they must be retained for 5 years after the end of your employment. Examples include a copy of your ID and your income tax statement.
What are your rights?
