When do we collect your personal data?

We collect your personal data from the moment you enter or leave your details on our Website or WhatsApp, apply for a job, register yourself on our website, use MySpirit and/or the Spirit App, sign up for a newsletter or otherwise sign up or are notified to use our services.

We may also collect personal data from you if you have posted it on public resources that might indicate an interest in our services. In that case, we will approach you in accordance with our terms and conditions and in compliance with this privacy statement. If you are not interested, we will delete your personal data.

What personal data do we collect from you?

We process the personal data necessary for our services; some of this data is mandatory in order to use our services. Additional data may be desirable in order to better tailor our services to the wishes and qualities of our employees or to meet more specific requests or obligations from our clients.

Why do we collect your personal data?

We collect and process your data to conduct our business activities including entering into assignment agreements, recruitment & selection, personal development and employability, payroll and personnel management. More specifically, personal data is processed to:

provide information about our Services;

be able to offer commercial offers, newsletters and promotional campaigns, only if you have signed up for them via the opt-in system. An unsubscribe option is included with every communication along these lines;

Manage and enhance commercial relationships with clients;

assess an applicant's suitability and availability in connection with recruitment, selection and appointment;

Establish and maintain an employment relationship and carry out the relevant personnel and payroll administration for this purpose;

fulfill our reintegration obligations;

be able to conduct pre-employment screening for the benefit of our clients and secure the deployment of personnel;

promote personal development and employability, including training, education and testing;

achieve management purposes, including management information, providing internal controls and corporate security, and conducting audits and auditing;

achieve quality purposes such as employee satisfaction and certification; apply for subsidies, premium discounts, etc;

comply with laws and regulations, including but not limited to identification, labor, tax and social security laws, anti-fraud and national and international sanctions laws.

With whom do we share your personal data?

Spirit Hospitality Services may transfer your personal data to another entity within Sendersens Hospitality Group, its clients, suppliers, government agencies and other business relations. And in all other cases in which we may be obliged to do so, for example by a court order or a court judgment. We agree with these parties in a processing agreement that they will handle your data with care and they will only receive the data necessary to provide their service. These parties use your data only in accordance with the instructions we provide and not for their own purposes. These include our web and app builder, our suppliers of the various software systems, our occupational health and safety service and our trainers.

The provision of personal data is made on the basis of a legitimate interest, legal obligation and/or for the performance of the agreement in accordance with the purposes mentioned under "Why do we collect your personal data?".
We will only process your data within the European Economic Area (EEA). Outside the EEA we will only process your data if that country provides an adequate level of protection for your data. Without your consent, we will never transfer your data to other countries or parties other than those listed above. Spirit Hospitality Services has taken the necessary measures to ensure that personal data transferred is adequately protected.

How long do you keep personal data?

Spirit Hospitality Services is committed to complying with the storage limitation principle. In this context, we will not store your personal data longer than necessary for the purposes we previously described. The retention periods we use depend on the applicable legal retention periods and/or guidelines.

Applications
Data will be retained for up to 4 weeks after the application process is completed and then automatically deleted. If Spirit Hospitality Services wishes to keep your data on file for up to 1 year for the purpose of possible future job openings, we will seek explicit written permission to do so.

Employees
Your personal data will be kept for two years after the end of employment. These data are then automatically deleted. Certain personal data is subject to a tax retention obligation, which means that this data must be kept for five years after the end of employment. Examples include a copy of your proof of identity and the payroll tax statement.

What are your rights?

The data we collect from you is personal. You therefore have the following rights: You may ask to see your data;
